Terms and Conditions & Privacy Policies — Apps

Please carefully review the following Terms of Service. By accessing, using, downloading, or sharing any material in the applications developed by INOVANEX.COM, you agree to follow and be bound by the Terms of Service. If you do not agree to the Terms of Service, you may not use the applications developed by INOVANEX.COM.

The Service in General

Our applications are developed by us for the exclusive use of each media outlet that hires them. These applications allow the reproduction of content via streaming audio, video, or both. The content is the responsibility of the media outlet that uses or leases the use of our application. INOVANEX only provides the media and development of the application to third parties.

Platform Registration

Listening to the radio, watching the channel or browsing the app does not require an account. To access the Chat and take part in Trivia, you must sign in with one of your accounts (Facebook, Google or Apple). The personal information we collect when you do so is described in the next section.

User Commitment

Every user of the chat service agrees to:

Maintain decent conduct and mutual respect when using this service.
Not use offensive, slanderous, or abusive language toward other users of this service.
Not violate applicable laws or regulations.
Not post commercial messages.
Not send repeated and indiscriminate messages in the chat, which may cause a degradation of service.

Information We Collect

If you create an account to use the Chat or Trivia, we store the following information:

Sign-in: when you sign in with Facebook, Google or Apple we store your name, profile picture, email address and a user identifier. Your sign-in account is managed with Firebase Authentication (Google).
Chat: the messages you send and, in apps where the media outlet enables it, the photos and voice recordings you share in the conversation. Each station's chat is purged automatically once a week and keeps only its 500 most recent messages.
Trivia and polls: your answers. For trivia with a prize, we may also ask for an email address and a phone number, used only to deliver the prize.
Notifications: a device identifier (push notification token) so we can send you alerts from the station.
Diagnostics: crash logs and app performance data, collected with Firebase Crashlytics to detect and fix errors. Technical logs are kept for ninety (90) days.

We do not share this information with third parties, and we do not sell it or pass it on for advertising purposes. Messages, images, audio and answers are for the exclusive use of the media outlet the app belongs to; INOVANEX processes them only as the developer and operator of the platform.

Required Permissions on Android & iOS

Our app requests the following permissions:

INTERNET and ACCESS_NETWORK_STATE: to connect and detect the network status.
WAKE_LOCK and FOREGROUND_SERVICE (with FOREGROUND_SERVICE_MEDIA_PLAYBACK): to keep playing while you use other apps or with the screen off.
POST_NOTIFICATIONS: to send you notifications.
RECORD_AUDIO: to record voice messages in the chat.
RECEIVE_BOOT_COMPLETED: to restore playback and notifications after the phone restarts.

The app does not request access to the camera or to the phone state.

Information Collection and Consent

When you use our Service, we collect your personal information and other information about you. Sometimes you will provide information directly, while other times we will collect it automatically or through a third party. In situations where your express consent is required, we will only collect your information if you expressly agree. By using the Service, you consent to our collection, use, and disclosure of your information. As permitted by law, consent to the collection of your personal information may be implied. In certain circumstances, express consent may be required, and we will do so if we determine that we must obtain it. Otherwise, your acceptance of this Policy indicates your consent to the collection, use, and disclosure of your information. Subject to legal and contractual restrictions, you may decline or withdraw your consent at any time by notifying us in accordance with this Policy. It is important to note that some of our Services require your personal information to function properly or to provide the Service to you, and in such cases, if you decline or withdraw your consent, the Service may not be available to you.

Third-Party Content

The Apps may contain links to third-party websites, applications, or other third-party services, and you understand and agree that we are not responsible for the availability or accuracy of such third-party properties or the content, products, or services available through such properties. We do not endorse or control such third-party properties and make no representations or warranties of any kind regarding such properties. If you access or use third-party properties, you should also be aware that the terms and policies of such third parties will govern. We also cannot control and do not guarantee any promotional prices offered by participating Partners.

User Information and Content

In these Terms, the content available through the Service, including all information, data, logos, marks, designs, graphics, images, videos, sound files, other files, and their selection and arrangement, is referred to as “Content.” Content provided by Users is referred to as “User Content.” User Content is the property of that User. You are solely responsible for your User Content and other materials you use as part of the Service.

Deletion of User Data

You can delete your account yourself in the app, under Menu ☰ → Settings → Delete my account; it runs immediately. If you have already uninstalled the app, you can request it in writing. Modifications to the Terms of Service

We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time without prior notice. You should periodically visit this page to review the current Terms of Service so that you are aware of any revisions to which you are bound. If we do so, we will post the changes to these Terms of Service on this page and indicate at the bottom of this page the date these terms were last revised.
